1 Information received and stored by

1.1 Basic Information When a computer is used to access, the following basic information is automatically received and stored by FRL’s web servers:

1.2.2 Payment processing and security of information Storage and accessibility of financial information Fantasy Rodeo League does not store credit card numbers or related financial information in its systems at any time. Accordingly, user supplied financial information is not accessible by FRL employees, officers, agents, or third parties other than the payment processor to whom the information is directly supplied by the user. Payment processing procedure When a user submits a credit card payment, a secure data connection is created between the user and Electronic Data Payment Systems (the “Processor”). Once the connection is created, the user’s financial information is transmitted directly and securely to the Processor and is never accessible to FRL.

Electronic Data Payment Systems passes the secure transaction information via a secure connection to the Merchant’s who submits the transaction to the credit card network (like Visa or MasterCard). The credit card network routes the transaction to the bank that issued the credit card to the customer.

The issuing bank approves or declines the transaction based on the customer's available funds and passes the transaction results back to the credit card network. The credit card network relays the transaction results to the merchant bank's processor. The processor relays the transaction results to Electronic Data Payment Systems which deposits the funds in FRL’s account after taking out a processing fee. Any recipient of a FRL email may unsubscribe from future messages via a link at the bottom of each email message. 1.6 Children and Fantasy Sports We believe in the importance of protecting the privacy of children online as well as the right of parents to determine the appropriateness of any activity for their children. Accordingly, our site is not intended for use by individuals under the age of 18 and is designed to prevent or dissuade such use. For this reason, both the registration process and payment processing procedures are designed to screen out individuals under the age of 18.

As we believe in personal responsibility and the right of a parent to raise their children in accordance with their own beliefs and values, we do allow children to participate with parental consent. In the case of, parental consent is assumed through the use of credit card payment systems. Although the use of credit card, and user-supplied information is less than perfect for these purposes, it is our experience, and industry practice, that such processes are the best methods for reasonably preventing access to the system by minors.

2 Terms of Service Fantasy Rodeo League is a game of skill. Although the Fantasy Rodeo League is based on the results of the National Finals Rodeo Challenge which is owned and operated by the Professional Rodeo Cowboys Association (“PRCA”), the Fantasy Rodeo League is not affiliated with or endorsed by the PRCA or the National Finals Rodeo. Like any fantasy sports league, the results of the NFR are simply used as real-world statistics of each contestants’ current performance.

Accordingly, the statistics and data used to determine the winners of the Fantasy Rodeo League will be determined from the official results of the National Finals Rodeo as published by the PRCA. Should the PRCA or the National Finals Rodeo alter or change the format or scoring of the NFR, the Fantasy Rodeo League will send a notice of any corresponding changes to players.

In the event of any ambiguity in the rules or the published results, FRL’s decision will be final and binding without regard to the final decision of the PRCA or NFR.

2.1 Player challenges The Fantasy Rodeo League is intended as a recreational activity in which players can apply their enjoyment of championship rodeo in a competitive and rewarding environment. Although we do not anticipate disputes in the enjoyment of the Fantasy Rodeo League, the following procedures outline the entire and exclusive remedies available to players.

2.1.1 Agreement to terms of service By registering an account with the Fantasy Rodeo League, you, the player, agrees to abide by these terms of service. Specifically, the player agrees to forego, waive, and forever give up any legal or equitable rights in exchange for playing Fantasy Rodeo League and by grant of the exclusive remedies herein.

2.1.2 Governing law The laws of the State of Oklahoma shall exclusively apply to any matters arising from, or in anyway related to the operation of or the Fantasy Rodeo League.

2.1.3 Challenge to Pool Size As described in the Game Rules, the size of the winning payout is based on the number of active (or paid) “teams” entered in the current season of Fantasy Rodeo League as of 12:01 a.m. on December 1, 2011. Although the size of the pool will be communicated to registered players, the names and information of registered players will remain confidential and will not be released. Should you, as a registered and paid player, dispute the announced size of the pool, you shall have the right, at your expense, to have the player roster examined and certified by an attorney at the Law Firm of Derryberry & Naifeh, 4800 N. Lincoln Blvd., Oklahoma City, OK 73105. Certification of the results shall be in the form of a signed and sworn affidavit that shall disclose the number of paid and registered players as of 12:01 a.m. on December 1, 2011, and shall not reveal any identifying information of any other players. The cost of any such certification shall be born entirely by the challenging player. The hourly fees charged by the certifying attorney shall be provided to the challenging player, in writing, and agreed to in writing by the challenging player prior to any certification. Said fees shall not exceed $300.00 per hour.

2.1.4 Binding Desk Arbitration Submission to binding arbitration. The player, registered user, or any other participant agrees that any controversy or claim arising out of or relating to this contract, or the Fantasy Rodeo League shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The cost of arbitration to be paid by the filing party. The arbitration fees shall be paid entirely by the party demanding arbitration. Additionally, each party shall bear their own attorney fees. However, the Arbitrator shall award attorney fees against any party whose claims are substantially without legal merit. Desk Arbitration. In lieu of a full hearing on the merits, the parties shall conduct a “desk arbitration,” as defined by the AAA, in which a decision is rendered on the briefs, evidence, and submissions of the parties. Should either party demand a full evidentiary hearing, then the award of attorney fees shall be mandatorily granted to the prevailing party. Confidentiality of records. The parties specifically agree that arbitration shall not require FRL, its officers, employees, or agents to disclose any information obtained from other users or pertaining to other registered accounts. The arbitrator shall have no power to compel the disclosure of any information disclosing the identities of other users and shall enter a protective order preventing and prohibiting any such disclosure during the arbitration proceedings. Class arbitration prohibited. The parties agree that the most expedient and fair way to resolve any disputes or controversies arising in any way, or related in any way to or the Fantasy Rodeo League is through individual arbitration. Class arbitration based on any theory or class constituency is hereby waived.

2.2 Payment Terms All sales on are final and it is up to the sole discretion of FRL to determine if any refunds or adjustments are warranted.

2.3 Game of Skill Fantasy Rodeo is a game of skill by which players are invited to analyze the past performance of champion level rodeo contestants based on publicly available information, as well as the players own skill and experience. The purpose of FRL is to promote the sport of rodeo and our game is subject to all federal, state, and local laws and regulations, and is not to be used as any type or form of gambling. Winners are determined by a user’s ability to select riders that will have the highest combined earnings, which is based on the user’s knowledge of the the sport.

2.4 Eligibility In order to play on FRL, users must be a legal resident of the United States of America or Canada. Residents of Arizona, Florida, Iowa, Louisiana, Maryland, Minnesota, Montana, Nebraska, North Dakota, Vermont, Puerto Rico, and Quebec are eligible to participate, but they are not eligible to receive prizes.

Employees of FRL are not eligible to participate.

2.5 Injuries If a rider is injured or cannot compete during the National Finals Rodeo for any reason, the rider will earn no cash and users will not allowed to select a new rider. 

2.6 Prizes All prizes will be paid in U.S. dollars.

2.7 Winner Notification Winners will be notified at the email address used during their registration to verify the address at which their earnings will be mailed. Winners will be notified no later than 14 days after the National Finals Rodeo is over.

2.8 Taxes Users are required to report any taxes due on prizes. In the event that a user's prize totals $600 or more, a 1099 will be issued showing the amount of the prize.

2.9 Disqualification FRL reserves the right to disqualify any user at any time without notice or any reason. A disqualification forfeits a user's prizes. Refunds are not offered to disqualified users.

2.10 Website Errors FRL agrees to use its reasonable endeavors to maintain the website in a fully operating condition and error free. As FRL cannot guarantee that the website will always be fully operational, FRL accepts no responsibility for any defects that may exist or for any costs or losses arising from your use of or inability to access the website.
